Background
1. Learniee (“we”, “us” and “our”) provides an online marketplace and platform (the “Service”) for Learners to find and enroll into classes (“Classes”) and engage in other educational activities and offerings, and for teachers to create, market and schedule classes for Learners to enroll and conduct Classes. As the provider of an online marketplace, Learniee does not create, sell, resell any Classes. Learniee’s responsibilities are limited to:
a. providing the Service as an online market place and platform to facilitate the enrollment, session booking and conduction of Classes, and
b. serving as the limited agent of each teacher for the purpose of accepting payments from a parent on behalf of the teacher.
2. In order to use certain features and functionalities of the Website, Users are required to provide certain personal information which may include name, email address, location, educational qualifications and other details.
3. This Privacy Policy sets out LEARNIEE's policy on the collection and use of personal information collected from Users on the Website. The purpose of this Privacy Policy is to explain to Users what information is collected, how it is used, and the rights of Users with respect to their information provided to us.
4. By accessing and using the Website, Users agree and consent to the collection and
processing of their personal information in accordance with this Privacy Policy.
Definitions
1. Website means the website owned and operated by Learniee located at www.learniee.com.
2. "User" or "You" refers to any individual who accesses or uses the Website, including without limitation, learners (“Learner”), teachers (“Teachers”), parents (“Parents”) partners (“Partners”), or any other persons interacting with the services provided through the Website.
3. “Learner” means an individual who either desires to enroll in a session or is already enrolled in a session offered on the Learniee platform, with the intention of gaining knowledge, skills, or guidance through its personalized learning experience.
4. “Parent” means a person or legal guardian who registers and may purchase Classes for the purpose of enrolling their child.
5. “Teacher” means a person who registers to creates and provides the classes for Learner to book the classes.
6. “Partners” refers to third-partyorganizations that collaborate with us, including but not limited to schools,nonprofit entities, technology providers, businesses, and employers. Thesepartners support the platform or its users but are distinct from Educators anddo not deliver classes themselves.
7. “Services” means the services provided byLearniee to Users pursuant to these Terms, including the online marketplace andplatform for classes.
8. “Personal Information” means anyinformation that can be used to identify an individual User of the Website, butdoes not include information that has been anonymised so that it does notidentify a specific User.
9. “Non-Personal Information” means anyinformation that cannot be used to identify a specific individual, includingbut not limited to broadly demographic, technical, usage and preferenceinformation which is collected automatically.
10. “Classes” refers to educational coursesthat are created and delivered by Teachers.
11. “Educational Activities” refers to groups,challenges, and other forms of interactive engagement offered through or inconnection with Learniee, which any Learner may participate in whether theseofferings are paid or provided free of charge.
A. Guest Access
You may be granted limited access to theLearniee platform as a guest, without the requirement to create an account ordisclose personal information. In such instances, Learniee does not verify, andassumes no responsibility for, any information you voluntarily provide whileaccessing or using the platform in guest mode.
B. Account Registration
1. To access and make full use of all features, services, and benefits offered on the platform, you must create an account.
2. The account on the Platform shall only be created by an individual who is 18 years of age or older. In cases where the individual is below 18 years of age or other wise ineligible to enter into binding agreements, their parent or legal guardian must create the account on their behalf. By doing so, the parent or legal guardian is deemed to have read, understood, and agreed to all the policies and terms outlined on the website.
Learniee shall presume that all accounts have been created in accordance with this requirement, and shall not be held responsible for any misrepresentation of age or authorization. All actions taken through such accounts shall be deemed to be with the full consent and responsibility of the parent or legal guardian, where applicable.
3. During the registration process, you may be asked to provide certain personal information necessary for account creation.
4. Learniee may, in the future, include further optional data fields to better personalize your user experience and improve platform functionality. We may also maintain records of communications such as phone calls or emails received from or initiated by you for inquiries, feedback, or support purposes, in order to enhance the efficiency and quality of our services, marketing for indeterminate period of time.
C. Data Collected by Us
a. Data provided by the user or you
1. Account Data
To access specific features of the website, you are required to create an account and complete the registration process as either a Learner or a Teacher. During this process, we collect certain basic information, which may include, but is not limited to, your name, email address, state and country of residence, username, password, and mobile number.
2. ‘KYC’ Information
If you are a teacher registered with us, we may collect your Know Your Customer (KYC) information, which may include your Permanent Account Number (PAN), Aadhaar number, and supporting documents. This information is collected solely for the purpose of completing our verification process and fulfilling obligations under applicable agreements or arrangements entered into with you. Such information may be retained, at our discretion, to prevent the creation of multiple accounts, detect and deter identity fraud, and for other legitimate future reference purposes, in accordance with applicable terms within our privacy policy.
3. Visibilityof Account
For Teachers
If you are a teacher, we will collect additional information from you to create your public profile on the website, where applicable. This profile is intended to help Learners and other Users learn more about you.
Your public profile will include information necessary for Learners or Users to identify and engage with you such as your username, a brief description of the content you have made available on the website, your educational qualifications, professional background or associations, photograph, and other similar details that may help Users better understand your expertise.
The content of your public profile is based on the information you provide and may be updated by you through the appropriate sections of the website. We rely on the accuracy and authenticity of the information submitted and assume that it does not impersonate or misrepresent any other individual. In the event that any suspicious, false or misleading information is detected, your account verification may be revoked, and you may be held liable for fine of Rs. 25,000/- and required to provide an explanation.
Teachers may choose to anonymize or pseudonymize their public profile name to protect their privacy and have the discretion to select a username of their choice. However, it is mandatory to provide accurate and verifiable personal identity information to us during registration and verification.
For Learner
If you are a Learner, your public profile will be visible to the Teachers of the classes in which you are currently enrolled, as well as to those whose classes you may enroll in the future. This allows Teachers to analyze your previous learning activity and performance in order to better tailor their teaching methods and content to your needs. Your profile may include your name, profile photo, learning preferences, and other relevant details necessary to support a personalized and effective learning experience.
Teachers of the classes you have joined will have access to this information. Additionally, platform administrators may monitor this information to identify discrepancies or misuse. If it is found that anyone other than the registered Learner is accessing or benefiting from the account whether a previously declared beneficiary or an unauthorized individual appropriate actions may be taken. This may include the imposition of fines or other corrective measures, at the sole discretion of Learniee.
Such actions are final and not subject to challenge. However, if you believe an error has occurred or wish to raise a concern, you may contact us at support@learniee.com. All decisions related to violations, enforcement, and remedial actions will be determined solely by Learniee and shall be considered final and binding.
4. Payment Details
For Student
i. Payment Gateway
When you make a purchase on the website, we use third-party payment processors (such as Razorpay, PhonePe, and Google Pay) to process your payments. These processors collect information necessary to complete the transaction, including but not limited to your name, payment method, billing address, transaction ID, and details of the Services purchased. Learniee does not store or process this payment data directly.
In cases where payments are made to you (e.g., for refunds or earnings), we may collect your financial account details, payment information, and relevant transaction history, including the purpose of payment. This information may also be used for fraud detection and prevention purposes.
ii. Learniee Wallet
We collect and store data related to your Learniee Wallet, including but not limited to wallet balance, transaction history, and details of funds added or spent. This information is used to facilitate transactions, manage your account, and enhance user experience. All wallet-related data will be deleted upon permanent deletion of the Learner’s account.
For Teachers
i. As a Teacher on the Learniee platform, you will have the option to receive payments for your services via the Learniee Wallet. You may choose to add your UPI ID, bank account number, or both, in order to withdraw your earnings. These details are required to facilitate secure and timely payouts.
ii. Learniee does not currently allow direct integration with third-party payment processors (e.g., Stripe, PayPal) by individual Teachers. All payment processing is conducted internally through the Learniee Wallet system using the payout information provided by you.
iii. When setting up your payout account through the Learniee Wallet, we collect necessary financial information including, but not limited to:
a. UPIID and/or Bank Account Number
b. Payment account email address
c. AccountID
d. Physical address (for verification)
e. Other relevant details required for transaction processing and regulatory compliance.
iv. Teachers will be able to view their wallet balance through their dashboard, reflecting earnings accrued from paid classes, demos, or other services rendered. However, withdrawal of funds will only be permitted after 15 days from the successful completion of the respective class or service, allowing time for any applicable refund requests or dispute resolution.
This 15-day holding period is designed to ensure compliance with Learniee's refund and quality assurance policies. The duration of this holding period may be modified at the discretion of the platform administrator, based on operational or policy requirements.
Withdrawals can be requested after the holding period has lapsed, and such requests are typically processed at the end of each month.
v. For platform integrity and compliance, Learniee retains full control and visibility over all wallet transactions. This includes the right to initiate refunds, apply adjustments, or impose fines in accordance with Learniee's refund policy, particularly in cases such as:
a. Misconduct or violation of platform rules
b. Failure to show up for paid classes or paid demos
c. Breach of service expectations
In such events, the admin may access relevant wallet data to take appropriate action. Refunds to Learners, if applicable, will be processed in accordance with the terms outlined in Learniee’s Refund Policy.
5. User-Generated and Activity Data Collection
We collect information related to:
(i) the Classes, Activities, or other Services you or a Learner participate in;
(ii) any content you submit or share through the platform, including but not limited to uploaded images, drawings, videos, audio recordings, and your interaction history; and
(iii) feedback and communications you provide, such as reviews of Classes or Educators, inquiries, and any information submitted to our customer support team.
Additionally, we may collect the content of your communications and messages where necessary to facilitate the Services you access, ensure compliance with our platform policies, or improve user experience.
b. Automatic Collection of Data
i. Technical and Device Data
When you access or use our Platform, we may automatically collect certain technical data typically provided by web browsers, mobile devices, and servers. This may include, but is not limited to, your IP address, browser type and version, device identifiers, operating system information, language preferences, referring URLs, access timestamps, and mobile network details.
ii. Interaction and Engagement Data
We may collect data regarding your interactions with the Platform. This includes, but is not limited to, the features you use, services or products viewed or purchased, and the timing of your activity. Additionally, we collect detailed usage data such as search terms entered, links or items clicked, pages visited, error messages encountered, and other behavioral insights that help us better understand your engagement with the Platform.
iii. Approximate Location Information
We may determine the approximate geographic location of your device using your IP address. This information is used to analyze the geographic distribution of our user base and to improve or tailor the services and content provided on our Platform.
iv. Use of Cookies and Similar Technologies
We may utilize cookies and similar tracking technologies to collect data about your usage of the Platform. Cookies are small data files stored on your device that help recognize your browser during future visits and enhance your experience. These technologies may also be used for purposes such as analytics, platform functionality, and personalized content delivery. v. Session Recordings
We may record user interactions on our Platform, including but not limited to actions such as clicks, taps, scrolling behavior, mouse movements, and non-sensitive keystrokes. These session recordings are used solely for the purposes of analyzing user behavior, improving platform functionality, and enhancing the overall user experience.
All such recordings are the exclusive intellectual property of Learniee. We reserve full rights to store, use, reproduce, and manage these recordings at our sole discretion. By using the Platform, you waive any rights to compensation or claims related to publicity, copyright, or similar matters in connection with these recordings.
In the event that a user, during a recorded or live session, expresses views or makes statements that are offensive, inappropriate, or objectionable, such views remain solely those of the user. Learniee does not endorse, support, or take responsibility for any opinions, remarks, or statements made by users during such sessions. For more information, please refer to our Terms and Conditions.
c. DataSharing and Disclosure
i. Disclosures Within Our Corporate Group
Learniee may share your data with its affiliates, subsidiaries, and associated entities under common ownership. These parties are contractually obligated to use such data only as necessary for providing or supporting our services, and in alignment with this Policy.
ii. Engagement with External Vendors and Processors
To ensure seamless service delivery, we may disclose limited Personal Information to third-party vendors such as payment processors, hosting providers, marketing services, customer support systems, and analytics firms, for service-related purposes.
iii. Sharing via Integrated Educational Platforms
To foster collaboration between User and Content Providers, we may share essential information with third-party tools or platforms used to host forums, virtual classrooms, or community-based learning features.
iv. Compliance with Legal and Regulatory Obligations
We reserve the right to disclose Personal Information if legally required or when such disclosure is deemed necessary to protect the rights, safety, or property of Learniee, our users, or the public, or to prevent fraud or misuse of our services.
v. Change in Ownership or Corporate Structure
In the event of a merger, acquisition, sale, or similar restructuring, your Personal Information may be transferred to a successor entity. Such transfers will continue to be governed by this Privacy Policy.
D. Purpose for Processing Personal Information.
i. Provision of Services and Platform Access.
We process your Personal Information to enable your access to Learniee’s Platform and the services hosted on it. This includes, but is not limited to, user account creation and management, customer support, transaction processing, identity verification, and technical maintenance. Such processing is necessary for the performance of a contract between you and Learniee.
ii. Enhancement of Platform Functionality and Security
Your data helps us continuously optimize Learniee’s Platform and services. We use analytics derived from your interactions to improve our user interface, launch new features, and ensure compatibility across devices. Moreover, we rely on this information to detect, prevent, and investigate misuse, technical malfunctions, fraudulent behavior, or other harmful activities that may compromise the integrity, availability, or confidentiality of Learniee’s systems or those of its users. This processing is carried out in Learniee’s legitimate interest of ensuring operational resilience and legal compliance.
iii. Promotional Outreach and Communication
We may utilize your information to promote Learniee’s services, features, and relevant educational content that aligns with your preferences and previous interactions on the Platform. This includes sending you updates, promotional messages, service recommendations, and user satisfaction surveys. This is done under Learniee’s legitimate interest in maintaining user engagement and expanding its educational offerings.
iv. Legal Claims and Dispute Resolution
We may process your information when required to establish, assert, or defend legal rights in court or any other competent legal forum. This includes safeguarding Learniee’s legal interests in disputes involving fraud, intellectual property violations, or breach of our Terms of Use. The legal basis for this is Learniee’s legitimate interest in defending itself from legal risk or regulatory exposure.
v. Risk Management and Professional Consultation
Learniee may process user data to assess operational risks or in connection with professional advice from legal, financial, or technical consultants. This processing is necessary to safeguard our business, maintain compliance with statutory obligations, and ensure continuity of service. This is carried out under our legitimate interest to protect and future-proof the platform.
vi. Data-Driven Insights and User Understanding
Learniee utilizes aggregated usage data to better understand how users interact with various features on the Platform. This insight helps us identify high-engagement areas, optimize underperforming segments, and shape our future service strategy in line with learner preferences. This processing is grounded in our legitimate interest in data-informed platform development.
E. Rights Of user
As a User of the Learniee Platform, you may exercise below rights regarding your personal data through the available account settings upon logging into your profile. If you face any technical difficulties or require further clarification, you may contact us directly via support@learniee.com.
a. Right to Access and Confirmation
You have the right to get confirmation and access to your Personal Information that is available publicly in the platform along with other supporting information.
b. Right to Rectification
If you believe that any Personal Information, we hold about you is inaccurate, outdated, or incomplete, you have the right to request correction or updating of such data.
c. Right to Erasure
You may request the deletion of your personal information from our records. Please note, however, that this may result in the permanent deletion of your account on the platform, and the data may not be recoverable. Certain information may still be retained for analytical purposes.
d. Identity Verification
Please note that these rights are applicable solely to your own Personal Information. Upon receiving request for exercising the above rights via email or physical communication, we may require additional information to verify your identity and to confirm your association with the Platform before proceeding with your request.
F. Amendment of Privacy Policy.
We may update this Privacy Policy periodically to reflect changes in our business operations, legal obligations, or data processing practices. While we may, at our discretion (unless otherwise required under applicable laws).
G. Enforcement and Finality of Decision
Learniee reserves the sole and exclusive right to determine, in its discretion, any and all actions in relation to account violations, platform misuse, information discrepancies, breach of terms, or any conduct inconsistent with the integrity of the platform. Such actions may include, but are not limited to, verification revocation, imposition of fines, account suspension, restriction of access, refund denial, or permanent account termination.
All such decisions shall be considered final, binding, and conclusive, as users agree to abide by Learniee's platform policies upon account creation and continued use of the services. Users expressly acknowledge and accept that enforcement decisions may require judgment-based assessments and are deemed binding within the operational scope of the platform, provided they are made in good faith and in accordance with internal policies.
If a user believes a decision was made in error, they may contact our support team at support@learniee.com. Learniee may, at its sole discretion, review such concerns; however, it shall not be under any obligation to modify, reverse, or reconsider its decision unless mandated by applicable law.
In the event of a dispute that cannot be resolved through Learniee’s internal grievance redressal process, both parties agree to submit the matter to final and binding arbitration under the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration shall be conducted in English, seated in Mumbai, India, and governed by the laws of India. Each party shall bear its own legal costs unless otherwise directed by the arbitrator.
Users further agree to waive any right to initiate or participate in any class action, group litigation, or representative legal proceedings against Learniee. By continuing to use the platform, you expressly acknowledge, understand, and agree to these dispute resolution terms.
